Minimum Qualifications

All applicants must meet the education and/or experience requirements as stated on this exam bulletin to be accepted to the examination.

Unless otherwise stated in the Minimum Qualifications, qualifying experience may be combined on a proportionate basis if the requirements stated below include more than one pattern and are distinguished as "Either" 1, "or" 2, "or" 3, etc. For example, applicants possessing qualifying experience amounting to 50% of the required time of Pattern 1 and additional experience amounting to 50% of the required time of Pattern 2 may be accepted to an examination as meeting 100% of the overall experience requirement.

Experience: One year of experience in the California Department of Health Services performing the duties of a Chief, Food and Drug Unit.

 

Or Two

Experience: Two years of experience in the Food and Drug Branch with the California Department of Health Services performing the duties equivalent to a Supervising Food and Drug Scientist (Foods); Supervising Food and Drug Scientist (Drugs); or Supervising Food and Drug Scientist (Medical Devices).

Or Three

Experience: Three years of experience in the Food and Drug Branch with the Department of Health Services performing the duties equivalent to a Food and Drug Scientist (Foods); Food and Drug Scientist (Drugs); Food and Drug Scientist (Medical Devices), Range B; Food and Drug Regional Administrator; Food and Drug Program Specialist; or Staff Toxicologist (Specialist).

 

Or Four

Experience: Four years of experience in the Food and Drug Branch with the California Department of Health Services performing the duties of a Supervising Food and Drug Investigator.

 

Or Five

Education: Possession of a Doctorate Degree from a recognized college in Food Technology, Food Microbiology, Food Chemistry, Pharmacology, Pharmacy, Pharmaceutical Chemistry, Biomedical Engineering, Bioengineering, Toxicology, or a closely related field relevant to Food and Drug control work. and

 

Experience: Broad and extensive experience (more than five years) gained after the doctoral degree in scientific research, evaluation, and development of new production technologies or safety and efficacy testing in the area of Food Technology, Food Microbiology, Food Chemistry, Pharmacology, Pharmacy, Pharmaceutical Chemistry, Biomedical Engineering, Bioengineering, Toxicology, or a closely related field relevant to Food and Drug control work.

 

Or Six

Education: Equivalent to graduation from college with at least 30 semester units of college courses in one or a combination of bacteriology, biology, chemistry, food technology, pharmacology, environmental health, biomedical engineering, or other biological or chemical science. (Up to 15 semester units in criminal justice may be credited toward 15 of the 30 total units required above.) and

 

Experience: Broad and extensive experience (more than seven years) in progressively responsible food, drug, or medical devices regulatory work. (Possession of a Master's Degree from a recognized college in Bacteriology, Biology, Chemistry, Food Technology, Pharmacology, Environmental Health, Biomedical Engineering, or other biological or chemical science may be substituted for one year of the required regulatory experience.)

Position Description

Plan, organize, and direct a major Food and Drug Branch program, such as the Drug and Consumer Product Safety Section, Medical Device Safety and Stop Tobacco Access to Kids Enforcement Section, and Food Safety Section; direct a multidisciplinary staff in all activities for the program including: (1) development, review, and analysis of complex scientific research studies; and (2) uniform education, consultation, inspection, investigation, enforcement, and administration of laws pertaining to the safety of consumer products. Activities include determining the design and scope of industry education efforts and whether: (1) particular production, control, distribution, labeling, advertising or other practices, and industry claims of safety are scientifically valid; (2) complaints received warrant an investigation and the degree and timing of the investigation; (3) violations are occurring and if so the nature and health consequences of the violations; (4) to take or seek corrective actions against violators and unsafe products and the nature and severity of the actions;

(5) industry-proposed corrective actions are or would be effective; and (6) proposed changes to State and Federal laws would impact the public, industry, or the Department and the appropriate response to any changes or impact. Incumbents assure that these activities are conducted in a manner that is timely, effective, reasonable, and uniform statewide. Incumbents seek and analyze relevant available scientific, technological, medical, and other information from sources within and outside the organization (e.g., the Federal Food and Drug Administration and the Centers for Disease Control) and integrate this information into their decision- making. If relevant information is not available, incumbents arrange for the development of studies necessary to generate the information. Incumbents act as spokespersons for the major program; manage relevant legislation and regulations; respond to requests from the public, press, Legislature, industry, health professionals, and others for information about the major program; and clearly and effectively communicate the major program's positions, decisions, and other actions. Activities include interpreting the provisions of applicable Federal and State statutes and regulations; coordination with Federal, State, and local law enforcement and health protection agencies; and liaison with manufacturers, transporters, advertisers, sellers, and others in connection with the statutes and regulations administered by a Food and Drug Section. Incumbents perform administrative duties and supervise and evaluate staff performance; receive or make appropriate recommendations for action; recommend new legislation or budget proposals to enhance or improve a major program's operations; develop appropriate budgetary documents; adhere to budgetary constraints; prepare or supervise the preparation of various reports by which evaluation of a major program's progress and accomplishments can be made; receive appropriate peace officer training consistent with function and Peace Officer Standards and Training (POST) certification requirements; perform arrests and searches; testify in administrative, civil, and criminal proceedings. Incumbents participate in meetings with technical, governmental, scientific, legislative, industry, and consumer groups and may represent the Department at such meetings; assist the Chief, Food and Drug Branch, in the development of a major program's plans; and prepare comprehensive reports and correspondence.

Examination Information

The examination will consist of five Supplemental Questions that are weighted 100%. Applicants are required to respond to the following five supplemental items. These supplemental items are designed to identify job achievement in specific areas that demonstrates the ability to successfully perform at the Chief, Food and Drug Section level. Responses to the supplemental items will be assessed based on predetermined job- related rating criteria. In appraising the relative qualifications of candidates, consideration will be given to the extent and type of pertinent experience and education over and above that required under the minimum qualifications.

 

The Department of Public Health reserves the right to revise the examination plan to better meet the needs of the service if the circumstances under which this examination was planned change. Such revision will be in accordance with civil service law and rules and all competitors will be notified.

Eligible List Information

A Departmental Open eligible list for the CHIEF, FOOD AND DRUG SECTION Classification will be established for:

The list(s) will be abolished 24 months after being established, unless the needs of the State and conditions of the list(s) warrant a change in this period.

Resulting Eligibility List(s) will be used to fill vacancies throughout the State of California.

Possession of the entrance requirement does not assure a place on the eligible list. In order to obtain a position on the eligible list, a minimum rating of 70% must be attained. Names of successful competitors are merged into the open eligible list established for use by the Department of Public Health in order of final scores regardless of testing date. Eligibility expires 24 months after it is established unless the needs of the service and conditions of the list warrant a change in this period.

Veterans' Preference will be granted for this examination. Veterans' Preference is an assistance program for veterans, veteran widows and widowers, and spouses of 100% disabled veterans who seek employment with the state. General Qualifications: Applicants must possess essential personal qualifications including integrity, initiative, dependability, good judgment, the ability to work cooperatively with others, and a state of health consistent with the ability to perform the assigned duties of the class. A medical examination may be required. In open examinations, investigation may be made of employment records and personal history and fingerprinting may be required.

Eligible Lists: Eligible lists established by competitive examination, regardless of date, must be used in the following order: 1) sub-divisional promotional, 2) departmental promotional, 3) multi-departmental promotional, 4) service-wide promotional, 5) departmental open, 6) open. When there are two lists of the same kind, the older must be used first. Eligible lists will expire in one to four years unless otherwise stated on the bulletin.

High School Equivalence: Equivalence to completion of the 12th grade may be demonstrated in any one of the following ways: 1) passing the General Education Development (GED) Test; 2) completion of 12 semester units of college-level work; 3) certification from the State Department of Education, a local school board, or high school authorities that the competitor is considered to have education equivalent to graduation from high school; or 4) for clerical and accounting classes, substitution of business college work in place of high school on a year-for-year basis.
