00109502 - DEPUTY LABOR COMMISSIONER I

For the purposes of meeting the minimum qualifications in this series, “relevant field of work” includes; but is not limited to, interpreting and enforcing labor laws or employment standards; analyzing employee grievances, payroll, or labor-related data; resolving workplace disputes; conducting investigations or audits involving wage and hours issues or employment practices; developing worker outreach or compliance programs; or advocating for labor protections, equity, and fair practices, or professional level work in the investigation and/or complaints regarding violations of state or federal labor laws or regulations.

MINIMUM QUALIFICATIONS

Equivalent to completion of the 12th grade. and

Four years of experience performing analytical or technical duties in a relevant field of work. At least one year of the required experience must be at a level equivalent to or higher than a Labor Compliance Representative. 

Academic education from an accredited college or university may be substituted for the required experience on a year-for-year basis. 

Position Description

00109502 - DEPUTY LABOR COMMISSIONER I

This is the full journey level. Under general supervision, incumbents serve as investigators on wage theft, wage-theft related issues and other violations of the California Labor Code overseen by the Labor Commissioner's Office. The complexity of the cases varies from cases of average complexity, up to multi-faceted complexity based on experience.

Typical duties include conducting and leading investigations to determine compliance with State labor laws and Industrial Welfare Commission orders, and to resolve related disputes; issuing assessments and citations; assessing and collecting unpaid wages, damages, and civil penalties; initiating administrative, civil, or criminal actions and referrals; preparing and serving administrative subpoenas; preparing and filing court documents, including subpoenas, judgments, levies and liens; and consulting with legal staff on case strategy, labor laws, regulations and policies.

Incumbents also prepare evidence for appeal hearings, including witness coordination, cross-examination, and direct testimony; may represent the division at hearings; conduct public outreach and provide information about labor laws, regulations, and division services; assist lower-level staff with investigative methods and case development; hold settlement conferences; interview witnesses; take statements; gather and evaluate evidence; review records for accuracy and compare them against testimony; reconstruct actual hours worked and calculate wages, damages, and penalties owed; meet with employers, employees, and their representatives to advise them of legal requirements and secure compliance; inspect workplaces and employment records to determine compliance with the provisions of the Labor Code, Industrial Welfare Commission orders, and applicable regulations; respond to public inquiries regarding working conditions, complaints, cases, and labor enforcement processes; and train lower-level staff on the above duties.

A Departmental Open eligible list for the DEPUTY LABOR COMMISSIONER I Classification will be established for:

The names of successful competitors will be merged onto the eligible list(s) in order of final score regardless of test date. Eligibility expires 12 months after it is established. Applicants must then retake the examination to reestablish eligibility.

Resulting Eligibility List(s) will be used to fill vacancies throughout the State of California.

Possession of the entrance requirements does not assure a place on the eligible list. Your performance in the examination described in this bulletin will be rated against a predetermined job-related rating, and all applicants who pass will be ranked according to their scores.

Department of Industrial Relations reserves the right to revise the examination plan to better meet the needs of the service, if the circumstances under which this examination was planned change. Such revision will be in accordance with civil service laws and rules and all applicants will be notified.

General Qualifications: Applicants must possess essential personal qualifications including integrity, initiative, dependability, good judgment, the ability to work cooperatively with others, and a state of health consistent with the ability to perform the assigned duties of the class. A medical examination may be required. In open examinations, investigation may be made of employment records and personal history and fingerprinting may be required.

Eligible Lists: Eligible lists established by competitive examination, regardless of date, must be used in the following order: 1) sub-divisional promotional, 2) departmental promotional, 3) multi-departmental promotional, 4) service-wide promotional, 5) departmental open, 6) open. When there are two lists of the same kind, the older must be used first. Eligible lists will expire in one to four years unless otherwise stated on the bulletin.

High School Equivalence: Equivalence to completion of the 12th grade may be demonstrated in any one of the following ways: 1) passing the General Education Development (GED) Test; 2) completion of 12 semester units of college-level work; 3) certification from the State Department of Education, a local school board, or high school authorities that the competitor is considered to have education equivalent to graduation from high school; or 4) for clerical and accounting classes, substitution of business college work in place of high school on a year-for-year basis.

Accepted applicants must provide proof of identification at each in-person test session. Acceptable identification consists of a photo identification card or two forms of signed identification.
