For the purposes of meeting the minimum qualifications in this series, “relevant field of work” includes; but is not limited to, interpreting and enforcing labor laws or employment standards; analyzing employee grievances, payroll, or labor-related data; resolving workplace disputes; conducting investigations or audits involving wage and hours issues or employment practices; developing worker outreach or compliance programs; or advocating for labor protections, equity, and fair practices, or professional level work in the investigation and/or complaints regarding violations of state or federal labor laws or regulations.

MINIMUM QUALIFICATIONS

Equivalent to completion of the 12th grade. and

Six years of experience performing analytical or technical duties in a relevant field of work. At least two years of the required experience must be at a level equivalent to or higher than a Deputy Labor Commissioner I.

Academic education from an accredited college or university may be substituted for the required experience on a year-for-year basis.

Position Description

00109536 - DEPUTY LABOR COMMISSIONER II

This is the advanced journey level. Under direction, incumbents either serve as Hearing Officers or act as lead investigators on the most complex and sensitive cases, which may involve large or multiple entities, represented defendants, numerous witnesses, extensive audits, and novel or intricate legal issues from investigation through final determination.

In addition to performing the duties described at the lower level, incumbents are responsible for issuing decisions that constitute final orders of the Labor Commissioner and are entered as judgments in Superior Court; providing subject matter expertise in specific industries of case types; serve as expert witnesses in administrative, civil, and criminal proceedings; and lead projects to develop new tools and strategies to enhance operational efficiency and program capacity.

Incumbents also mentor and advise lower-level staff; lead teams on smaller projects; develop training manuals and deliver presentations to educate staff and external stakeholders on labor laws, regulations, and departmental procedures; administer hearings, handle appeals, or prosecute cases on behalf of the division, including co- chairing with division attorneys on complex cases involving wage assessments, damages, civil penalties, or benefit claims; and may serve as a Deputy in Charge of an office, as assigned.

A Departmental Open eligible list for the DEPUTY LABOR COMMISSIONER II Classification will be established for:

The names of successful competitors will be merged onto the eligible list(s) in order of final score regardless of test date. Eligibility expires 12 months after it is established. Applicants must then retake the examination to reestablish eligibility.

Resulting Eligibility List(s) will be used to fill vacancies throughout the State of California.

Possession of the entrance requirements does not assure a place on the eligible list. Your performance in the examination described in this bulletin will be rated against a predetermined job-related rating, and all applicants who pass will be ranked according to their scores.

Department of Industrial Relations reserves the right to revise the examination plan to better meet the needs of the service, if the circumstances under which this examination was planned change. Such revision will be in accordance with civil service laws and rules and all applicants will be notified.

General Qualifications: Applicants must possess essential personal qualifications including integrity, initiative, dependability, good judgment, the ability to work cooperatively with others, and a state of health consistent with the ability to perform the assigned duties of the class. A medical examination may be required. In open examinations, investigation may be made of employment records and personal history and fingerprinting may be required.

Eligible Lists: Eligible lists established by competitive examination, regardless of date, must be used in the following order: 1) sub-divisional promotional, 2) departmental promotional, 3) multi-departmental promotional, 4) service-wide promotional, 5) departmental open, 6) open. When there are two lists of the same kind, the older must be used first. Eligible lists will expire in one to four years unless otherwise stated on the bulletin.

High School Equivalence: Equivalence to completion of the 12th grade may be demonstrated in any one of the following ways: 1) passing the General Education Development (GED) Test; 2) completion of 12 semester units of college-level work; 3) certification from the State Department of Education, a local school board, or high school authorities that the competitor is considered to have education equivalent to graduation from high school; or 4) for clerical and accounting classes, substitution of business college work in place of high school on a year-for-year basis.

Accepted applicants must provide proof of identification at each in-person test session. Acceptable identification consists of a photo identification card or two forms of signed identification.
