Job Description and Duties

This is a Limited Term position that may become Permanent/FT

An Attorney in the Dispute Resolution Division works as a mediator with supervision, and is expected to have a commanding understanding of the laws the Department enforces. Under the supervision of the Assistant Chief Counsel of the Dispute Resolution Division, with some review and authority, the Attorney facilitates communications between complainants and respondents to discuss their dispute and reach a mutually agreeable resolution

    Department Information

    The Civil Rights Department (CRD or Department) is the civil rights enforcement agency for the State of California. CRD's mission is to protect all people in California from employment, housing and public accommodation discrimination, human trafficking, and hate violence.

     

    The CRD is the largest state civil rights enforcement agency in the country. It enforces the California Fair Employment and Housing Act (FEHA), Unruh Civil Rights Act, Disabled Persons Act, Ralph Civil Rights Act, and the California Trafficking Victims Protection Act. The Department has jurisdiction over both private and public entities operating within the State of California, including corporate entities, private sector companies that contract with the State of California, and all State departments and local governments. 

    The CRD receives, investigates, conciliates, and initiates individual and systemic discrimination complaints in its five offices throughout California. CRD litigates individual, class, group and systemic cases in all California jurisdictions, including state and federal courts. It leads education and outreach efforts to stakeholders and the public, and has an active regulatory and legislative program.

    Telework Opportunity

    As operationally allowed, a hybrid work schedule is available for employees who can perform their essential functions remotely.

    Desirable Qualifications

    In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

     

    Completion of at least 40 hours of verifiable formal mediation training that includes conflict resolution, mediation theory and role-play and mastery of the laws governing mediation, including, but not limited to confidentiality.

    • Mediation of numerous cases alleging employment, housing, or other forms of discrimination that may or may not have specified claims under Fair Employment and Housing Act, Unruh Civil Rights Act, and/or Ralph Civil Rights Act violations to conclusion in the role of mediator.

    • Excellent communication skills and ability to effectively interact with people in emotionally charged situations.

    Ability and experience in the role of mediator to effectively analyze issues in dispute, evaluate their importance and susceptibility to compromise and formulate ideas and practical suggestions for alternative solutions.

    • Experience conducting mediations via videoconference using web-based platforms such as Zoom or other videoconferencing platforms.

    • Ability to multi-task, meet deadlines and work well under time constraints.

    • Excellent organizational and case management skills.

    • Integrity, initiative, tact, dependability, good judgment, and ability to work independently and cooperatively.

    • Ability to operate a computer and knowledge of MS Excel, Word, and Teams and other critical software programs.

    • Ability to travel to conduct State business.

Describe your experience in mediating and/or litigating civil rights cases (including employment cases), working with unrepresented parties or with counsel on sensitive and difficult topics related to violence or systemic discrimination, and any other experience that is relevant to this position.
