Job Description and Duties

Under the general direction of the Labor Commissioner and Deputy Chief of the Division of Labor Standards Enforcement (DLSE) (or Labor Commissioner’s Office (LCO)), the Assistant Deputy Chief of Policy, Enforcement & Training serves as a principal policy advisor and enforcement strategist and is responsible for the research, creation, and facilitation of essential policy-making activities and processes, including the creation and execution of internal evaluation protocols; oversees timely implementation of legislative and regulatory mandates across all DLSE jurisdictions and integrates best practices to ensure efficacy and effectiveness; develops and implements a data-informed and collaborative enforcement training program to ensure accurate application of laws in coordination with program executive leaders, and leads evaluation efforts on training, enforcement, and other implementation initiatives to identify and assess opportunities for improvement. The incumbent will play an essential role in evaluating, developing, and setting tailored policy for the LCO specific enforcement operations, training needs, and implementation responsibilities. Specifically, the CEA will provide programs with general Division-wide policies and training tools to ensure application of law is consistent, appropriate, timely, and leverage all available resources within the DLSE.

The Assistant Deputy Chief of Policy, Enforcement & Training consults with, advises, and assists the Labor Commissioner, Deputy Chief, and other DLSE executives in anticipating, identifying, and analyzing issues relevant to emerging policy issues and manages the division's creation, implementation, and evaluation of various policies, enforcement, and training programs. The incumbent facilitates discussions with programs on prominent policy issues and is expected to work closely with Assistant Chiefs, other executive team members such as the DIR Deputy Chief of Legislative and Regulatory Affairs and Special Policy Advisor as well as other legislative, enforcement and training teams within DIR divisions as required to leverage DLSE’s enforcement impact. The incumbent works directly with program leaders and various internal and external stakeholders to consider, formulate and implement policy proposals, enforcement collaborations, and training needs.

Please respond to the following questions in your SOQ with specific information in each of your responses. 

1. Describe your scope and the number of years of experience in which you engaged with societal obstacles that workers and law-abiding employers confront in their employment and business management.
              a. In your response, please include the largest societal obstacles currently facing workers when defending themselves at work to obtain legal wages and a workplace free of retaliation.
              b. Also include, the largest obstacles employers face in complying with California laws as they pertain to wages, registration requirements and retaliation.
              c. Explain strategies that can be implemented to facilitate the elimination of these obstacles for workers with respect to defending themselves and for employers with respect to complying with the law.

2. Describe your scope and number of years of experience implementing legal requirements, increasing workplace requirements, increasing compliance or correcting harm caused by noncompliance. In your response, please include how your experience assisted you in addressing challenges and initiatives you developed to minimize or address those challenges.

3. Describe your scope and number of years of experience in designing and executing substantive training to professionals who worked in different aspects of law and in different geographies. In your response, please include what you learned from addressing any obstacles you encountered and if you would do anything differently today.

4. Describe your scope and the numbers of years of experience in which you worked on a piece of legislation or a policy that your organization supported. In your response, please include challenges or obstacles you may have encountered.

5. Describe your scope and number of years of experience with specific labor laws you were responsible for implementing or for increasing compliance. In your response, please include your role in formulating departmental or organizational-wide policies to implement or increase compliance with these laws and the impact the policies had on your operations and stakeholders.

6. Describe your leadership and managerial experience, including number of years of experience working with senior level executives or organizations over whom you did not have supervisory authority, nevertheless needing their cooperation to meet a particular goal. In your response, please provide specific examples of what you needed them to do and how you gained their cooperation or motivated them to work with you, particularly when there were conflicts or disagreements.

7. Describe your scope and number of years of experience measuring the success of a training program and evaluating and improving the work of an organization. In your response, please include the tools used to measure the success of the training program or to evaluate the need for improvement.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  • Demonstrated a high level of experience in relation to understanding obstacles facing workers in obtaining legal wages, free from retaliations, employer’s compliance with wages, registration requirements and retaliation and provide strategies the Labor Commissioner’s office can implement to facilitate in eliminating said obstacles.

 

  • Demonstrated a high level of experience in relation to challenges facing the California Labor Commissioner’s Office regarding implementing legal requirements, obtaining employer compliance and maximizing existing tools to increase sustainable compliance.

 

  • Demonstrated a high level of experience in relation to designing and executing substantive training to professionals who worked in different aspects of a law and in different geographies.

 

  • Demonstrated a high level of experience in working on a piece of legislation or a policy that the candidate’s organization supported.

 

  • Demonstrated a high level of experience with specific labor laws you have been responsible for implementing or for increasing compliance, formulating departmental or organizational-wide policies to implement or increase compliance with these laws and the impact on communities and State.

 

  • Demonstrated a high level of experience working with senior level executives or organizations.

 

  • Demonstrated a high level of experience in evaluating and improving the work of an organization, provide tools to measure the success of the training program or to evaluate the need for improvement.

 

  • Demonstrated ability to communicate effectively in writing, as evidenced by the Statement of Qualification (SOQ).
