Job Description and Duties

Under general direction with minimal supervision by the Chief Counsel, the Attorney IV/III has responsibility for performing difficult and complex legal work. This includes addressing legal issues involving state fiscal and budgetary matters (including capital outlay), reimbursement of state-mandated activities, public contracting, the California Public Records Act, open meetings laws, the Administrative Procedure Act, and conflict of interests. Among other duties, the Attorney IV/III will:
  • Independently review and research the most complex legal issues involving state fiscal matters. These issues involve broad policy areas impacting the state budget, public financing, public works projects, local programs and related litigation. These issues can involve highly political and extremely sensitive areas related to the department’s fiscal responsibilities and require the Attorney IV/III to exercise sound judgment and discretion.
  • Advise the Department on issues regarding reimbursable state mandates. Represent the Department and respond to issues presented before the Commission on State Mandates, and work with the Attorney General’s Office on state mandate litigation.
  • Manage cases, determine litigation strategy, work with the Attorney General, and provide other litigation support relating to litigation involving the Department or other state entities.
  • Research and draft legal advice relating to the Department’s fiscal responsibilities.
  • Draft and review budget and trailer bill language.
  • Track legislation and litigation involving other state departments that may have a significant fiscal impact.
  • Respond to inquiries regarding state fiscal issues; other related duties as required.
The Attorney IV/III should be familiar with or have an interest in the state budget process, mandates law, public contract law, Open Meeting Act requirements, and the Public Records Act in order to effectively provide written and oral advice to the Department.

Special Requirements

Finance operates under a hybrid telework model, which requires employees to work in the office (report to headquarters) for a minimum of two days during the workweek. The hybrid policy is subject to change, and additional in-office days may be required at management's discretion.

As of July 1, 2025, Finance employees will be required to work in the office a minimum of 4 days a week. The hybrid policy is subject to change, and additional in-office days may be required at management's discretion.
